What a valid DMCA notice must include
To be effective, your notice must be in writing and include substantially all of the following:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the material on the Site that you claim is infringing, with enough detail for us to locate it (for example, the exact page URL).
- Your full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Your physical or electronic signature.
Counter-notices
If your content was removed as a result of a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice to the same copyright agent. Your counter-notice must include your name, address, phone number, and email address; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; a statement consenting to the jurisdiction of the Federal District Court for your district (or, if you are outside the United States, any judicial district in which DroidOrbit may be found); and your physical or electronic signature.
Repeat infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright.
Misuse of the DMCA process
Please note that submitting a false or misleading DMCA notice or counter-notice may expose you to liability, including court costs and attorneys’ fees, under 17 U.S.C. § 512(f). If you are unsure whether material infringes your copyright, consider consulting an attorney before filing a notice.
